Neither are illegal. Jailbreaking is a 3rd party workaround for getting 3rd pary applications on to the iPod touch. There is nothing illegal about that. You technicaly violate your end of the iPod’s EULA (end user license agreement) but that doesn’t make it illegal. All it means is that apple is free to not hold up their end and they don’t have to support the iPod. Its the same if you were to crack open the seal on your iPod and try and change the battery. Nothing illegal about it, but apple doesn’t have to fix it when you screw it up.
Jailbreaking will give you the same apps as the ones in the january update with some exceptions. They would all be the older versions so you wouldn’t get some of the new map features. Also the jailbreaking way of moving apps around isn’t quite the same as the fancy shake ‘n bake way that the update does it. On top of that there are hundreds of other applications availible with a jailbroken device.
Now the offical upgrade availible is just the tip of the iceburg as the SDK (software developers kit) is coming out in the end of Feb and then apple will have offical 3rd party apps availible that won’t require any extra work (or the negative conotation that people seem to have) like jailbreaking the touch would.
