i know jailbreaking is free but i don’t want to void the warranty and if downloading the new software is the same i’d rather just pay 10$ and be safe.

Downloading the new software is legal. Jailbreaking is illegal and causes many bad side effects to your iPod.
well the firmware 2.0 is not already jail broken, it just allows applications downloaded off the app store to run on it. jail breaking is enabling read/write access to the file system. you must have your ipod/iphone jail broken to run applications downloaded off Cydia and installer(installer is still being debugged but is on its way)
